Terms of Service

Last updated: June 3, 2026

These Terms of Service (the “Terms”) govern your access to and use of FairwayNation, a golf tournament management platform (“FairwayNation,” the “Service”) operated by Lead From Here, LLC (“we,” “us,” or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 18 years old and able to form a binding contract to use FairwayNation. If you use the Service on behalf of an organization (a club, charity, company, or similar), you represent that you are authorized to bind that organization to these Terms, and “you” refers to that organization.

2. Your account

You are responsible for the information you provide, for keeping your login credentials secure, and for all activity that occurs under your account. Notify us promptly at [email protected] if you suspect unauthorized use. We are not liable for losses caused by unauthorized use of your account.

3. What FairwayNation does

FairwayNation provides software that lets organizers create tournament registration pages, collect registrations and payments, manage sponsorships and donations, communicate with participants, and run their events. We provide the tools; you are responsible for the events you run, the content you publish, the participants you accept, and your compliance with applicable law.

4. Organizer responsibilities

If you use FairwayNation to collect money or run an event, you acknowledge and agree that:

  • You are solely responsible for your events, including pricing, descriptions, refunds, cancellations, scheduling, and delivery of whatever you promise registrants, sponsors, and donors.
  • You are responsible for determining, collecting, and remitting any taxes associated with your events, and for any charitable-solicitation or raffle/gaming registration your activities may require.
  • You will provide accurate event information and will not use the Service to collect money for events you do not intend to hold.
  • You are responsible for handling participant data you collect in accordance with our Privacy Policy and applicable law.

5. Payments, fees, and Stripe

Payments on FairwayNation are processed by Stripe. To collect money, organizers connect a Stripe account through Stripe Connect. By doing so, you agree to the Stripe Connected Account Agreement, and Stripe—not FairwayNation—is responsible for processing and settling those funds. We do not take custody of registrant or donor funds; they flow to the organizer’s connected Stripe account.

Platform fees. Depending on your plan, we may charge a platform fee on payments processed through the Service, in addition to Stripe’s own processing fees. The applicable platform fee for your plan is shown on our pricing page and in your dashboard before you collect payments. Stripe’s processing fees are set by Stripe.

Subscriptions. Paid plans (such as Pro and Club) are billed in advance on a recurring annual basis through Stripe and renew automatically until cancelled. You can cancel from your dashboard; cancellation stops future renewals and takes effect at the end of the current billing period. Except where required by law, subscription fees already paid are non-refundable. If a renewal payment fails, we may suspend paid features until the balance is resolved.

6. Acceptable use

You agree not to use the Service to:

  • violate any law or regulation, or infringe anyone’s rights;
  • upload malicious code, attempt to gain unauthorized access to the Service or other accounts, or interfere with its operation;
  • send spam, harvest data, or process payments for fraudulent, deceptive, or prohibited activities; or
  • misrepresent your identity or your affiliation with any person or organization.

We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure for us, our payment partners, or other users.

7. Your content

You retain ownership of the content you submit to the Service (tournament details, logos, images, copy, and participant data you collect). You grant us a non-exclusive, worldwide license to host, store, reproduce, and display that content solely as needed to operate and provide the Service. You represent that you have the rights necessary to submit that content and to grant this license.

8. Our intellectual property

FairwayNation, including its software, design, and trademarks, is owned by Lead From Here, LLC and protected by intellectual-property laws. These Terms grant you a limited, revocable, non-transferable right to use the Service; they do not transfer any ownership to you.

9. Third-party services

The Service relies on third parties—including Stripe (payments), Mailgun (email), and cloud storage and analytics providers—as described in our Privacy Policy. Your use of those services through FairwayNation may be subject to their own terms, and we are not responsible for their acts or omissions.

10. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any event run through it will succeed.

11. Limitation of liability

To the fullest extent permitted by law, Lead From Here, LLC and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid us in the twelve months before the claim arose, or (b) one hundred U.S. dollars (USD $100).

12. Indemnification

You agree to indemnify and hold harmless Lead From Here, LLC from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your events, your content, or your violation of these Terms or of any law or third-party right.

13. Termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms or if we reasonably believe it is necessary to protect the Service, our users, or our partners. Provisions that by their nature should survive termination (including Sections 7–12) will survive.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you, such as by email or a notice in the Service. Your continued use after the changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of [GOVERNING-LAW-STATE], without regard to its conflict-of-laws rules, and you agree to the exclusive jurisdiction of the state and federal courts located there for any dispute arising out of these Terms or the Service.
